PLANNING COMMISSION MINUTES

11/20/03 - 6:30 p.m.

Town Hall

 

I.          CALL TO ORDER:

 

            Chairman Karl Walton called the meeting to order at 6:40 p.m.  Members present were:  Karl Walton; Cliff Bordeaux; Len Viera (6:50).  Alternate Michelle Hayward was seated for Brad Pellissier.  Also present was Town Planner, Patrice Carson.

 

II.            AUDIENCE PARTICIPATION:    There was none.

 

III.       OLD BUSINESS:            There was none.

 

Cliff Bordeaux made a motion to take the agenda items out of order; seconded by Michelle Hayward and unanimously approved by the Commission.

 

V.            STAFF/COMMISSIONER REPORTS:

 

            Patrice Carson reported that she attended a meeting concerning the Whittaker property with the Board of Selectmen; Board of Finance Chairman and the Town Treasurer to review the property appraisal received by the Town.

 

A meeting is scheduled for 11/24/03 at 9:00 a.m. with Tom Maziarz of CRCOG and persons interested in purchasing and developing the Somersville Mill property.

 

Patrice asked for permission to attend the CCAPA Executive Board meeting on December 5, 2003.  Cliff Bordeaux made a motion to approve the Town Planner's attendance at the CCAPA 12/5/03 meeting; seconded by Michelle Hayward and unanimously approved by the Commission.

 

The CRCOG annual report on Connecticut home sales has been received.  Somers went from (5) to (7) in ranking.

 

VI.            AUDIENCE PARTICIPATION:    There was none.

 

VII.            CORRESPONDENCE AND BILLS:                        There was none.

 

 

VIII.            MINUTES APPROVAL:            November 6, 2003

 

            Cliff Bordeaux made a motion to approve the 11/6/03 minutes, as written.  This motion was seconded by Karl Walton and unanimously approved by the Commission.

 

The Commission returned to New Business.

 

IV.       NEW BUSINESS:

             a.            Reconfiguration of Lots, 79 Denison Road, Top of the Town, LLC/Somers Sportsmens Association

 

            Karl Walton recused himself and Cliff Bordeaux acted as Chairman for this item only.

 

Attorney John Parks presented a site plan reconfiguration to the Commission for their review.  On May 11, 2000, a court decision separated a parcel from the remaining land owned by Top of The Town, LLC.  The lawsuit has reached a settlement.  The Somers Sportsmens Association will take ownership of all land with the exception of a two acre area that Top of the Town, LLC will be retaining.

 

A few changes were made to the drawing.  The driveway must be l0' away from the property line.  The site plan must be signed by the Sanitarian.

 

A motion was made by Michelle Hayward, seconded by Len Viera and unanimously voted to approve the reconfiguration of property of Top of the Town, LLC and Somers Sportsmens Association, Inc. at 79 and 85 Denison Road, as shown on map entitled, "Boundary Line Adjustment Plan, Area Claimed By:  Somers Sportsmen Association, 79 Denison Road, Somers Connecticut", with the following conditions:

            1.            Addition of block for Sanitarian's signature

            2.            Move the property line to be 10' from the driveway and show measurement

            3.            Show 25' measurement from the corners of the barn to side property line

4.            Add language to the (2) parcels on the map to show land of Top of the Town, LLC to be conveyed and combined with land of Somers Sportsmen.

This reconfiguration does not constitute a subdivision because no new lot is created.

 

IX.            ADJOURNMENT:

 

            Motion to adjourn made by Michelle Hayward; seconded by Len Viera and unanimously approved by the Commission.  The meeting adjourned at 7:00 p.m.
