ZONING BOARD OF APPEALS

REGULAR MEETING MINUTES

May 11, 2004

 

 

Call To Order: Chairman Torres called the meeting to order at 7:30 P.M.

 

Members Present: John Torres, Ed Mack, Sr., Dan Scully, Jim Beaulieu, Jim Meagher, Jr., Barbara Flebotte.  Absent: Pamela Lloyd.

 

Chairman Torres called the Public Hearing to order at 7:31 P.M.

 

Public Hearing

          1.  Joann and Charles Batchelor

 

Acting Secretary, Ed Mack, Sr., read the legal notice.  Chairman Torres recused himself as he is an abutter for this application.  Alternate, Barbara Flebotte was seated.

 

Applicant, Joann Batchelor approached the Board to request a variance for a 5 foot side yard setback for a proposed bedroom addition at 85 Bridlepath Drive.  After presenting her proposal, abutters were asked to come forward.  Abutters, James and Theresa Bodolay of 77 Bridlepath Drive approached the Board to oppose the application and offered several possible alternative options available to the applicant, in their opinion.  After discussion with all interested parties ended, Mrs. Batchelor thanked the Board.

 

          2.  Paul and Mylene Logan-Zdanis

 

Acting Secretary, Ed Mack, Sr., read the legal notice.  Chairman Torres was re-seated.

 

Applicant Paul Logan-Zdanis and abutting neighbor, Jesse Martello of 74 Ninth District Road approached the Board.  Mr. Logan-Zdanis is requesting a variance for a side-yard setback for a proposed attached garage and mud room addition at 80 Ninth District Road..  Mr. Martello supports the applicant’s request.  No other abutters were present.  Mr. Logan-Zdanis thanked the Board.

 

          3.  Kevin and Cheryl Kossick

 

Acting Secretary, Ed Mack, Sr., read the legal notice.

 

Applicant Cheryl Kossick approached the Board to request a variance for a privacy fence at 8 Horseshoe Lane.  No abutters were present.  After discussion, Mrs. Kossick thanked the Board.

Motion made by Commissioner Scully to close the Public Hearing; second by Commissioner Mack, Sr.  Motion approved unanimously.  The Public Hearing ended at 8:08 P.M.

 

Minutes Approval - April 13, 2004

 

Motion made by Commissioner Scully to accept the ZBA 4/13/04 Minutes as presented; second by Commissioner Beaulieu.  Motion approved unanimously.

 

Public Hearing Discussion/Decision

 

1.          Joann and Charles Batchelor

 

Chairman Torres recused himself from discussion/decision; Barbara Flebotte was seated.  Motion made by Commissioner Beaulieu to cease discussion and vote; second by Commissioner Scully.  The Board voted 4-1 to deny applicant, Joann and Charles Batchelor, a 5' side yard setback variance; no hardship was evident.  Commissioners Meagher, Beaulieu, Flebotte and Mack opposed; Commissioner Scully in favor.  The variance was denied.

 

2.          Paul and Mylene Logan-Zdanis

 

Chairman Torres was re-seated.  Motion made by Commissioner Scully to cease discussion and vote; second by Commissioner Meagher, Jr.  The Board voted unanimously to deny the applicant’s request for a variance; no hardship was evident.

 

3.          Kevin and Cheryl Kossick

 

Motion made by Commissioner Scully to cease discussion and vote; second by Commissioner Mack, Sr.  The Board voted unanimously to deny the applicant’s request for a variance; no hardship was evident.

 

Old Business

1.     Complete update of “ZBA Applicant’s Guide”

 

The Board reviewed and discussed the draft for the ZBA Applicant’s Guide.  The ZBA Clerk will re-type and present to the Board in the future.

Chairman Torres handed out a copy of the Freedom of Information sheet to each Board member to be reviewed.

Bills

 

Motion made by Commissioner Scully to accept all bills including $417.11 for the Journal Inquirer; second by Commissioner Meagher, Jr.  Motion approved unanimously.

 

Adjournment

 

Motion made by Commissioner Beaulieu to adjourn the meeting; second by Commissioner Meagher, Jr.  Motion approved unanimously.  The meeting adjourned at 8:58 P.M.
