Special Meeting Minutes

October 19, 2004

 

Call To Order:  Chairman Torres called the meeting to order at 7:34 P.M.

 

Members Present:  John Torres, Dan Scully, Ed Mack, Jim Meagher, Jim Beaulieu and Barbara Flebotte.

 

Chairman Torres called the Public Hearing to order at 7:36 P.M.

 

Public Hearing

          1.  Jonathan and Patricia Normand

The Acting Secretary, Jim Beaulieu, read the legal notice.  Mr. Normand approached the Board to present his application.  A more detailed map was entered into record.  No abutters were present.

 

          2.  Michael Bushior

The Acting Secretary read the legal notice.  Mr. Bushior approached the Board to present his application for a variance.  Mr. Bushior entered several documents into record.  No abutters were present.

 

          3.  Worthington Pond Farm, LLC

The Acting Secretary read the legal notice.  Commissioner Mack recused himself for this application for personal reasons.  Chairman Torres seated Alternate, Barbara Flebotte.  Attorney Capossela, representing Mr. Roulier of Worthington Pond Farm, LLC, approached the Board.  Attorney Conti, representing Jim Taylor (Zoning Enforcement Officer), approached the Board.  Several residents opposed to having alcohol at Worthington Pond Farm approached the Board.  One resident in favor approached the Board.  One letter from Mr. Douglas Taylor opposed to alcohol was read into the record by Chairman Torres.

 

Motion by Commissioner Beaulieu to close the public hearing for Jonathan and Patricia Normand; second by Commissioner Meagher.  Motion approved unanimously.

 

Motion to close the public hearing for Worthington Pond Farm, LLC; second by Commissioner Scully; second by Commissioner Flebotte.  Motion approved unanimously.

 

Motion to continue the public hearing for Michael Bushior by Commissioner Beaulieu; second by Commissioner Meagher.  Motion approved unanimously.

 

The public hearing ended at 9:20 P.M.

 

Public Hearing Discussion/Decision

          1.  Jonathan and Patricia Normand

Motion made by Commissioner Mack to end discussion and vote on the Normand application; second by Commissioner Beaulieu.  Motion approved unanimously to approve request for an 11’ side yard variance to allow for location of a proposed 20X44’ attached addition to their garage for a proposed poolside screen room and storage area.

          2.  Worthington Pond Farm, LLC

Motion made by Commissioner Beaulieu to end discussion and vote on appeal of Cease and Desist order issued by ZEO on August 2, 2004; second by Commissioner Meagher.  The Board upheld the Cease and Desist Order by a vote to four to one.  Commissioners Torres, Meagher, Scully and Flebotte voted to deny the appeal; Commissioner Beaulieu voted in favor to appeal the Cease and Desist Order.

Correspondence

Bills

Motion made by Commissioner Meagher to pay all bills including the Journal Inquirer in the amount of $487.94; second by Commissioner Scully.  Motion approved unanimously.

 

Adjournment

Motion made by Commissioner Mack to adjourn; second by Commissioner Meagher.  Motion approved unanimously.  The meeting ended at 9:35. P.M.
