TOWN OF SOMERS

ZONING BOARD OF APPEALS

REGULAR MEETING MINUTES

December 14, 2004

 

Call To Order:  Chairman Torres called the meeting to order at 7:32 P.M.

 

Members Present:  John Torres, Edward Mack (Acting Secretary), James Meagher, Jr., James Beaulieu and Barbara Flebotte.  Absent:  Daniel Scully.

 

Public Hearing

1.      Joan Rivard

Chairman Torres called the public hearing to order at 7:33 P.M.  Alternate, Barbara Flebotte is seated for Daniel Scully who is absent.  The Acting Secretary read the legal notice.  Joan Rivard of 74 Maple Ridge Drive approached the Board to present her variance request.  No abutters were present.

 

Motion made by Commissioner Beaulieu to close the public hearing; second by Commissioner Meagher.  Motion approved unanimously.

 

The public hearing ended at 7:40 P.M.  The regular meeting resumed at 7:43 P.M.

 

Minutes Approval – November 9, 2004:  Motion made by Commissioner Mack to accept the ZBA 11/9/04 minutes as presented; second by Commissioner Meagher.  Motion approved unanimously.

 

Public Hearing Discussion/Decision

1.      Joan Rivard

After discussion, motion made by Commissioner Beaulieu to cease discussion and vote; second by Commissioner Meagher.  Motion approved unanimously to allow a 17’ side yard variance to Joan Rivard of 74 Maple Ridge Drive for an attached mud room and garage.

 

Old Business:  None.

 

New Business:  Somers High School student, Brittany Collins, attended the meeting as required by her History Civics class.  The Board welcomed Miss Collins and questions she had regarding the ZBA.

 

Chairman Torres informed the Board that the Town of Somers has received a summons from Worthington Pond Farm, LLC appealing the ZBA’s recent decision to Superior Court.  Chairman Torres has prepared a package of the file and given it to the Town Attorney.

 

Correspondence:  None.

 

Bills:  Motion made by Commissioner Flebotte to approve all ZBA bills including $503.68 for the Journal Inquirer; second by Commissioner Mack.  Motion approved unanimously.

 

Adjournment:  Motion made Commissioner Beaulieu to adjourn the meeting; second by Commissioner Meagher.  Motion approved unanimously.  The meeting ended at 8:05 P.M.
