ZONING MINUTES

REGULAR MEETING

Monday, March 21, 2005

7:00 p.m.     Town Hall

 

I.          CALL TO ORDER

 

Chairman Peter Klein called the regular meeting to order at 7:01pm.  Members Calder, Chipouras (7:05pm), Klein, Wood, and Alternate Member Conklin (seated for Martin) were present and constituted a quorum.  Town Planner Patrice Carson was also in attendance.

 

II.            MINUTES APPROVAL

 

A motion was made by Lise Wood, seconded by Jill Conklin and unanimously voted to approve the Minutes of the March 7, 2005 meeting as written.

 

III.       OLD BUSINESS

 

a.            Discussion/Possible Decision:  Site Plan Application for Change of Use to Retail Store, 12 South Road, Dwyer

 

The Commission reviewed the file.  At their last meeting the Planning Commission recommended approval of the site plan at their last meeting and felt it was a good use in the Business zone.  Any sign would have to be approved by the ZEO.

 

A motion was made by Lise Wood, seconded by A.P. Calder and unanimously voted to approve Dwyer’s Site Plan application for a change of use to Retail Store.

 

b.            Discussion:  Plan of Conservation and Development

 

Chairman Klein reported on the joint meeting with the Planning Commission last Wednesday, mainly discussing soil-based zoning.  The Planner will be putting together maps of previously approved subdivisions showing how the quality of lots would be adjusted under soil-based zoning.  There will be another joint meeting on Wednesday, April 13.  There will be more discussion on soil-based zoning as well as village districts.

 

Peter Chipouras expressed some concern about making sure the Commission meets its deadlines set forth in the POCD.  It was discussed that Commissioners should try and keep a list of the characteristics they feel would be important in Somersville.  It would be helpful to have a Design Review Board in place at the time the Commission adopts any changes in zoning regarding Village Districts.

V.            STAFF/COMMISSIONER REPORTS

 

The Commission received copies of and reviewed the ZEO’s report.  A motion was made by Lise Wood, seconded by A.P Calder and unanimously voted to accept the ZEO’s report.

 

VI.            CORRESPONDENCE AND BILLS

 

Bills presented:

            Office Max for supplies $22.30

            Journal Inquirer for 02/07 meeting            $47.22

 

A motion was made by Lise Wood, seconded by Jill Conklin and unanimously voted to approved the bills.

 

VII.            ADJOURNMENT

 

A motion was made by Lise Wood, seconded by Jill Conklin and unanimously voted to adjourn the Zoning Commission meeting of March 21, 2005 at 7:33pm.

Enforcement activity:

 

1. South Rd., Lipton Gravel Pit. Poor condition of tracking pad allowing trucks to track mud and gravel material onto route 83. Mr. Lipton has taken action to eliminate this problem.

     

2, 359 Mountain  Road. Worthington Pond, LLC. Section 214-87.D. (Sales & consumption of alcoholic  beverages .Issued Cease and Desist Order. Cease and Desist Order has been appealed to the ZBA with a hearing set for Sept 14, 2004. 9/20/04, The ZBA hearing has been continued to October 19, 2004. The ZBA voted to uphold the C&D order. Mr. Roulier has appealed the ZBA decision to the Superior Court. Case Pending.

 

3. 20 Haas Rd. R. Olden, Sections 214-101 (failure to obtain building permit) and 214-38 (housing farm animals less than 200 feet from the property lines as required. Issued C & D Order. 11/23/04 Referred file to Town Atty. 2/28/05 Resolution pending. This may not be resolved until late spring.

 

4. 112 Main St., F. Vono. Sections 214-101 (Failure to obtain Site Plan Approval and 214-98A (Exceeding Lot Coverage with Pavement). Issued C & D Order. 2/04/05 Mr. Vono has met with Land Use Department. Resolution Pending. 2/28/05 No Change.

 

5. 60 Springfield Rd., J. Gosselin. Section 214-56.B. & C. (Signs to be removed due to businesses being closed). Requested Compliance.
