ZONING BOARD OF APPEALS

REGULAR MEETING MINUTES

May 10, 2005

 

Call To Order:  Chairman Torres called the meeting to order at 7:34 P.M.

 

Members Present:  John Torres, Ed Mack, Sr., James Beaulieu, Dan Scully, James Meagher, Jr.  Alternates – Robert Minch and Barbara Flebotte.  Absent:  Martha Rainey.

 

Chairman Torres called the public hearing to order at 7:35 P.M.

 

Public Hearing

 

  1. Fotis I. Gazis:  Acting Secretary, Dan Scully, read the legal notice.  Mr. Lasse Aspelin who is representing Mr. Gazis approached the Board to discuss construction for a single-family home located at 99 Four Bridges Road.  No abutters were present. 

 

  1. James Trask:  Acting Secretary read the legal notice.  Mr. Trask approached the Board to request a side-yard and front-yard variance for a temporary shed at 78 Michele Drive until a permanent addition could be built.  Mr. Trask had received a cease and desist order from the Zoning Enforcement Officer to remove the temporary structure because it is currently non-conforming.  No abutters were present.  Mr. Trask cited the layout of his land as a hardship.  Mr. Trask has no immediate plans to build an addition.

 

  1. Steven and Lori Talbot:  Mr. and Mrs. Talbot approached the Board to request a side yard variance for the location of a detached garage/workshop at 904 Main Street.  Mr. Talbot cited a growing family and the layout of his land as a hardship.  No abutters were present.

 

After much discussion on all three applications, a motion was made by Commissioner Beaulieu to close the public hearing; second by Commissioner Mack.  Motion was approved unanimously.

 

Minutes Approval – April 12, 2005:  Motion made by Commissioner Scully to accept the ZBA April 12, 2005 Minutes as presented; second by Commissioner Mack.  Motion approved unanimously.

 

Public Hearing Discussion/Decision

 

  1. Fotis I. Gazis:  After much discussion, a motion was made to cease discussion and vote to allow a slab foundation or basement with a crawl space and to allow a two-level structure with a first floor totaling no more than 850 square feet, a side yard of 13.5 feet and a front yard of 27 feet at 99 Four Bridges Road by Commissioner Mack; second by Commissioner Meagher.  Motion approved unanimously.

  1. James Trask:  After much discussion, a motion was made to cease discussion and vote to deny a setback variance for a temporary structure located at 78 Michele Drive by Commissioner Mack; second by Commissioner Meagher.  Motion approved unanimously.  The Board found no hardship.  Mr. Trask was advised to work with the Zoning Enforcement Officer, Jim Taylor in the removal or relocation of his temporary structure.

 

  1. Steven and Lori Talbot:  After much discussion, a motion was made by Commissioner Beaulieu to cease discussion and vote to allow a 10 foot side yard variance for a two car garage and workshop located at 904 Main Street; second by Commissioner Meagher.  Motion approved unanimously.  The grade of the land was the identified hardship and the location of the septic system.

 

Old Business:  Chairman Torres presented the completed form to the DMV for St. Germain Automotive, LLC at 16 D Egypt Road, Somers.  The Board in a previous meeting had approved Mr. St. Germain’s application for new ownership.

 

New Business:  Chairman Torres stated the Town Clerk would like to eliminate one of the ZBA forms sent to applicants which is repetitious.  The Board agreed and the small duplicate form will no longer be included in the notification of an applicant’s decision.

 

Commissioner Scully and Commissioner Beaulieu submitted a master copy for the Acting Secretary’s roster. 

 

Commissioner Scully volunteered for Acting Secretary.  The Board approved whole-heartedly.

 

Correspondence:  None.

 

Bills:  Motion made by Commissioner Mack to approve all bills for the ZBA including $495.81 for the Journal Inquirer; second by Commissioner Meagher.  Motion approved unanimously.

 

Adjournment:  Motion made by Commissioner Scully to adjourn; second by Commissioner Beaulieu.  Motion approved unanimously.  The meeting ended at 9:30 P.M.
