ZONING BOARD OF APPEALS

REGULAR MEETING MINUTES

March 14, 2006

 

Call To Order:  Chairman Torres called the meeting to order at 7:35 P.M.

 

Members Present:  John Torres, Ed Mack, Dan Scully, Barbara Flebotte and Bob Minch.  Absent:  James Beaulieu.  Chairman Torres seated alternate, Bob Minch.

 

Public Hearing

 

  1. James Benedict

Chairman Torres called the public hearing to order at 7:36 P.M.  Secretary, Dan Scully, read the legal notice.  Mr. Benedict of 115 Bobolink Lane approached the Board to request a 22’ variance for location of a shed/pool house.  Abutters Kathleen and Harley Fuller stated they were strongly opposed to this variance for safety concerns.

 

  1. Bonnie Lowrie Dewitt

The Secretary read the legal notice.  T.J. Barresi, representing the applicant at 183 Mountain Road, approached the Board to request a variance to allow for location of a driveway via an existing access easement on adjacent property to the applicant.  Abutter Dan Dewitt approached the Board with concerns and questions.

 

After all discussion, motion made by Commissioner Mack to adjourn the public hearing; second by Commissioner Scully.  Motion approved unanimously.  The public hearing ended at 8:47 P.M.

 

The regular business meeting continued at 8:49 P.M.

 

Minutes Approval – February 14, 2006

Motion made by Commissioner Scully to accept the ZBA February 14, 2006 minutes as presented; second by Commissioner Mack.  Motion approved unanimously.

 

Public Hearing Discussion/Decision

 

  1. James Benedict

After much discussion, motion made by Commissioner Mack to cease discussion and vote; second by Commissioner Flebotte.  The Board voted unanimously to deny a variance to James Benedict of 115 Bobolink Lane for a shed/pool house.

 

  1. Bonnie Lowrie Dewitt

After much discussion, motion made by Commissioner Flebotte to continue the public hearing.  No second to the motion was made, therefore the motion failed.

 

After further discussion, motion made by Commissioner Minch to cease discussion and vote; second by Commissioner Mack.  The Board voted unanimously to approve a variance to allow a driveway on an existing access easement on adjacent property to 183 Mountain Road.

Bills

Motion made by Commissioner Mack to accept all bills for the ZBA including $566.64 to the Journal Inquirer; second by Commissioner Minch.  Motion approved unanimously.

 

Adjournment

Motion made by Commissioner Mack to adjourn the meeting; second by Commissioner Scully.  Motion approved unanimously.  The meeting ended at 9:10 P.M.
