The Zoning Board of Appeals consists of five regular members along with three alternate members who are appointed by the town Selectman.
Regularly scheduled meetings are held on the second Tuesday of every month and followed up as necessary to render a final decision within time
limits imposed by Connecticut General Statutes (CGS).
The Zoning Board of Appeals has the authority to hear and rule upon appeals of zoning decisions and determinations made by the officer of the
zoning regulations. The Zoning Board of Appeals' powers and duties include hearing and deciding all matters including special exceptions which
it is required to pass upon by the specific terms of the zoning regulations. The Board shall determine the appeal application with due consideration
for conserving the public health, safety, convenience, welfare, and property values solely with respect to a parcel of land where ordinances or
regulations would result in exceptional difficulty or unusual hardship so that substantial justice will be done and the public safety and welfare secured.
Appeals must be filed with the Zoning Board of Appeals in accordance with section 8-7 of the CGS. Hearings must commence within sixty-five days after
receipt of the appeal and the hearings must be completed within thirty days after it commences. All decisions of the Board must be made within sixty-five
days after completion of the hearing.
After making an application to appeal a decision of the Zoning Enforcement Officer, adjoining property owners are notified by mail and a public hearing is
conducted at a regular Zoning Board of Appeals meeting. Final decision is rendered by vote of the Board.
The Zoning Board of Appeals is responsible for hearing requests for variances of the Somers Zoning Regulations. Possible variance requests may include
(but are not limited to) items such as setback and side yard requirements and placement of accessory buildings. Applications must be filed at least three (3)
weeks prior to a regular meeting of the Zoning Board of Appeals in order to allow adequate time for publication in the Legal Notice section of the Journal
Inquirer. The Zoning Board of Appeals normally meets at 7:30 p.m. at the Somers Town Hall Conference Room, 600 Main Street, Somers Connecticut. Agendas are
posted at the Town Hall 48 hours prior to the meeting. Special Meetings and Public Hearings, their locations and times, will be posted separately.
